Terms of Service / User Agreement

These Terms govern your access to and use of Between Sets, an adults-only, fitness-focused dating and social matching platform operated from Ontario, Canada. By creating an account, joining through a trusted-access flow, purchasing a subscription, or using protected features, you agree to these Terms and the Privacy Policy. Do not use the service if you do not agree.

1. Eligibility

You may use Between Sets only if:

you are at least 18 years old, meet any higher applicable service-age rule, and are legally capable of entering this agreement;
you provide accurate account and eligibility information;
you are located in a jurisdiction and market that Between Sets has approved for dating access;
you are not prohibited by law from using the service;
you have not been removed from Between Sets for serious or repeated misconduct unless we expressly permit your return; and
you comply with applicable verification, legal-acceptance, rollout-access, privacy, trust-and-safety, and security requirements.

Acceptance of these Terms does not itself establish adult eligibility or identity. Protected dating features may remain unavailable while verification, jurisdiction approval, or eligibility is pending, unresolved, expired, or unsuccessful.

2. Accounts and security

You must provide accurate information and keep it reasonably current.
You may not create an account for another person, impersonate anyone, transfer an account, or share authentication credentials.
You are responsible for activity conducted through your account unless caused by a security failure attributable to Between Sets.
Notify support promptly if you suspect unauthorized access.
We may require additional verification before restoring access, processing sensitive requests, or releasing account information.

3. Privacy, consent, and protected information

Between Sets follows the principle: Verification establishes trust eligibility. Consent determines access.Verification does not automatically expose photos, locations, gym information, distances, or other protected profile data. Visibility remains subject to the profile owner's settings, consent, match or approval state, blocking decisions, and applicable authorization rules.

You may not attempt to bypass privacy controls, obtain direct protected-file URLs, scrape member information, infer precise location, identify a member outside the service without authorization, or use another person's information for harassment, surveillance, discrimination, fraud, or commercial solicitation.

4. Acceptable conduct

You agree not to:

threaten, harass, stalk, exploit, intimidate, deceive, or harm another person;
engage in hate, discrimination, sexual exploitation, trafficking, coercion, non-consensual conduct, or promotion of illegal activity;
use the service for escort services, prostitution, pornography, sexually explicit commercial services, sugar-dating transactions, compensated dating, or solicitation of sexual services;
upload content involving a minor or anyone who appears to be a minor;
share another person's private information, intimate content, messages, or images without permission;
send spam, scams, malware, deceptive links, credential requests, payment solicitations, gift-card or cryptocurrency requests, investment solicitations, or unauthorized advertising;
use automated systems, bots, scripts, scraping tools, or reverse engineering to access or copy the service;
circumvent access, age, verification, jurisdiction, payment, moderation, rate-limit, block, or security controls;
submit knowingly false reports or abuse support, appeals, referrals, founder rewards, or promotional programs; or
use Between Sets in a way that violates law, these Terms, or another person's rights.

5. Member content

You retain ownership of content you submit. You grant Between Sets a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for technical display, and show that content only as reasonably necessary to operate, secure, moderate, improve, and promote the service in accordance with your settings and our Privacy Policy. This licence ends when the content is deleted from active systems, subject to reasonable backup, legal, safety, fraud-prevention, and dispute records.

You represent that you have the rights and permissions needed to submit your content and that it does not violate law or another person's privacy, publicity, copyright, trademark, or other rights. We may scan, hold, remove, or restrict content that creates safety, legal, security, fraud, or policy risk.

6. Matching and in-person interactions

Between Sets provides software that may help adults discover and communicate with one another. We do not guarantee a match, relationship, compatibility, identity, intentions, conduct, fitness qualifications, gym affiliation, or background of any member. Verification and automated safety controls may reduce certain risks but are not a complete background check or guarantee.

Use independent judgment. Protect personal and financial information, communicate through the service until comfortable, meet in public, tell someone your plans, arrange your own transportation, and leave any situation that feels unsafe. For an immediate emergency, contact local emergency services rather than relying on an in-app report.

7. Reporting, blocking, moderation, and enforcement

You may report or block members through available tools. A block may restrict discovery, profile, match, message, and related access as required by the service. We may investigate, preserve relevant records, warn, restrict, suspend, remove content, disable features, terminate accounts, or contact authorities where reasonably necessary for safety, law, or enforcement.

Moderation and fraud decisions may rely on reports, account and payment signals, verification information, automated classifiers, and available evidence. Content may be allowed, blocked, or held for review. We do not promise to disclose confidential safety information, another member's personal information, thresholds, or internal detection methods. Available appeals do not automatically restore access. Safety concerns may be sent to safety@betweensets.ca.

8. Premium subscriptions and billing

Premium features, billing period, price, currency, taxes, trial terms, renewal terms, and material purchase terms are shown before checkout.
Paid subscriptions automatically renew for the selected billing period until cancelled unless the checkout states otherwise.
The selected payment processor collects payment-card details and processes transactions under its applicable terms and privacy practices. Between Sets stores provider references and entitlement state rather than complete card credentials.
You authorize the recurring charges presented at checkout until cancellation takes effect.
You may cancel through the available account or billing controls. Unless otherwise stated or required by law, cancellation stops future renewal and paid access continues through the current paid period.
Refunds, credits, chargebacks, and statutory cancellation rights are handled according to the purchase terms shown at checkout, processor/card-network rules, and applicable law. Nothing in these Terms removes a non-waivable consumer right.
We may change future pricing or plan features with advance notice where required. A price change does not retroactively alter a completed billing period.

9. Founder, referral, promotional, and complimentary access

Promotional codes, founder rewards, referral benefits, trials, and complimentary entitlements may have separate eligibility, qualification, expiry, transfer, and abuse-prevention rules. They have no cash value unless expressly stated, may not be sold or transferred, and may be corrected or revoked if issued through error, fraud, duplicate qualification, or policy abuse. An earned internal Premium entitlement should not create a paid checkout for the covered entitlement period.

10. Service availability and changes

Between Sets may launch by city, market, province, or country; use waitlists or trusted-access gates; limit features during testing; and change or discontinue features. Visible signup thresholds do not guarantee immediate launch, matching liquidity, uninterrupted access, or availability in every location. Provider outages, moderation capacity, security events, legal requirements, jurisdiction review, or operational limits may affect the service.

11. Intellectual property

The Between Sets name, software, interface, branding, documentation, and non-member content are owned by Between Sets or its licensors and are protected by applicable law. These Terms grant you a limited, personal, revocable, non-exclusive, non-transferable right to use the service for its intended purpose. No other licence is granted.

12. Suspension, termination, and account deletion

You may stop using the service or request account deletion through Account Data & Deletion. We may restrict, suspend, or terminate access where reasonably necessary for safety, fraud prevention, legal compliance, non-payment, chargebacks, identity or jurisdiction risk, material or repeated breach, or protection of the service and its members. Provisions that by their nature should survive termination—including payment obligations, content representations, enforcement rights, disclaimers, liability limits, and dispute terms—continue to apply.

13. Disclaimers

To the maximum extent permitted by law, Between Sets is provided on an "as is" and "as available" basis. We do not warrant uninterrupted or error-free operation, specific results, compatibility, or that every member statement, verification result, or moderation decision is accurate. We do not guarantee the conduct, identity, health, training expertise, intentions, or safety of another person. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

14. Limitation of liability

To the maximum extent permitted by law, Between Sets and its operators, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, opportunities, data, goodwill, or relationships arising from use of the service. Any limitation applies only to the extent permitted by applicable law and does not exclude liability that cannot legally be limited, including liability arising from fraud or wilful misconduct where the law so provides.

15. Governing law and disputes

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to non-waivable consumer rights and any law requiring a different forum, disputes may be brought before the courts located in Ontario, Canada. Before starting formal proceedings, you and Between Sets agree to make a reasonable attempt to resolve the issue through written notice to legal@betweensets.ca.

16. General terms

If a provision is unenforceable, it will be limited or removed only to the extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign this agreement without our written consent. We may assign it as part of a reorganization, financing, sale, or transfer of the service. Headings are for convenience only.

17. Changes to these Terms

We may update these Terms as the service, providers, or legal requirements change. We will post the revised version and update the date above. Material changes may require renewed acceptance before protected features are available. Continued use after the effective date of a valid update constitutes acceptance where permitted by law.
